1. Scope
These General Terms and Conditions (GTC) apply to all business relationships between Blue Marlin Redsea (hereinafter referred to as “we” or “us”) and our customers (hereinafter referred to as “customer” or “you”) in the version valid at the time of the conclusion of the contract.

3. Subject of the Contract
The subject of the contract is the booking of diving courses, dives, equipment rental, and other services offered on our website or on-site. The exact services and prices are specified in the respective offer descriptions on our website or on-site.
4. Conclusion of the Contract
The contract between you and us is concluded through your booking and our confirmation. The booking can be made via our website, by email, by phone, or on-site. By booking, you accept these GTC.
5. Prices and Payment
All prices are in euros (€) or the locally applicable currency unless otherwise stated. Payment can be made at the customer’s choice by bank transfer, credit card, PayPal, or in cash on-site. The full amount is due no later than at the start of the course or service.
6. Cancellation and Termination
6.1. Cancellation by the Customer:
The customer may cancel the booked service free of charge up to 14 days before the start. In the event of a cancellation up to 7 days before the start, 50% of the total costs will be charged. In case of cancellation within 7 days before the start, the full price is payable.
6.2. Cancellation by the Provider:
We reserve the right to cancel the contract for important reasons (e.g., bad weather conditions, unforeseen events). In this case, the customer will be informed immediately, and any payments already made will be fully refunded.
7. Liability
7.1. Liability for Damages:
Our liability for contractual obligations and tort is limited to intent and gross negligence. This limitation of liability does not apply to claims for injury to life, body, or health, nor to claims arising from the breach of essential contractual obligations.
7.2. Liability for Equipment:
The customer is liable for any damage to the equipment provided by us that is caused by improper use or negligence.
8. Participation Requirements
8.1. Health:
The customer assures that there are no health concerns regarding participation in diving activities. In case of doubt, a medical certificate must be provided.
8.2. Minimum Age:
The minimum age for participation in diving courses is 12 years. Minors require the consent of a legal guardian.
9. Data Protection

10. Applicable Law and Jurisdiction
The law of the Arab Republic of Egypt applies. The place of jurisdiction for all disputes arising from this contract is the location of our diving school in Hurghada.
11. Severability Clause
If any provision of these GTC is invalid or becomes invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose of the invalid provision.
